Your Responsibility & the Law

You are required by the Swimming Pools Act 1987 and the New Zealand Building Code, to fence your pool and the surrounding area to meet the requirements of your local council.

  • It is your responsibility as a pool owner to register this with your local council
  • You are responsible as a pool owner to see that you have complied with the Swimming Pools Act 1987
  • You cannot fill your pool until you have approval from your council

Fencing that complies with the Fencing of Swimming Pools Act 1987 is a critically important part of having a safe home environment for children.

You can cut the risks even further by:

  • always supervising children in or near a pool;
  • maintaining the fence and gate in a good condition;
  • setting rules of behaviour around the pool and teaching your child about water safety and swim and survival skills;
  • learn first aid and resuscitation;
  • always make sure tha gate to the pool is safely shut;
  • NEVER prop open the pool gate;
  • clear away toys and floatation aids from the pool when not in use.

It is your responsibility to check with the local council and get your pool fencing approved.
